1. Acceptance

By accessing or using ClawSouls ("the Service"), including ClawSouls Hosting, you agree to these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

ClawSouls provides: (a) a platform for discovering, sharing, and installing AI agent personas ("souls") for use with OpenClaw and compatible AI agent frameworks; and (b) ClawSouls Hosting, a paid cloud hosting service for running AI agents 24/7.

3. User Accounts

• You must sign in via Google or GitHub to use the Service.
• You are responsible for all activity under your account.
• You must not impersonate others or create misleading accounts.
• You must be at least 18 years old to use ClawSouls Hosting.

4. User-Generated Content

4.1 Ownership

You retain ownership of the souls and reviews you create. By publishing a soul on ClawSouls, you grant ClawSouls a non-exclusive, worldwide, royalty-free license to host, display, distribute, and make available your content through the Service, including via APIs, MCP (Model Context Protocol) servers, third-party directories, and integrations.

4.2 License

Each published soul specifies its own license (e.g., Apache 2.0, MIT). You are responsible for ensuring your soul's content is compatible with the license you choose. If no license is specified, the soul defaults to Apache 2.0.

4.3 Responsibility

You represent and warrant that:

• You have the right to publish the content.
• Your content does not infringe any third-party intellectual property rights.
• Your content does not contain malicious code, hate speech, or illegal material.
• Your content complies with the Community Guidelines.

4.4 Public Distribution

Published souls are publicly available. By publishing, you acknowledge that your soul's metadata and file contents may be accessible via the ClawSouls public API, MCP servers, third-party directories, and the ClawSouls CLI.

5. ClawSouls Hosting

5.1 Service Description

ClawSouls Hosting provides cloud infrastructure to run AI agents powered by the SoulClaw framework. Each hosted agent runs in an isolated container with dedicated storage.

5.2 Pricing

ClawSouls Hosting is billed per agent, per month. Current pricing is displayed on the hosting dashboard. Prices may change with 30 days' notice to active subscribers.

5.3 Free Trial

New agents may include a 7-day free trial. You will not be charged during the trial period. If you do not cancel before the trial ends, your payment method will be charged automatically.

5.4 API Keys & Third-Party Services

You may provide your own API keys (e.g., OpenRouter, Anthropic) for LLM access. You are solely responsible for the usage and costs associated with these third-party services. ClawSouls encrypts your API keys at rest but is not liable for any charges incurred through your keys.

5.5 Data & Storage

• Each agent has isolated storage. Your data is not shared with other users.
• Upon subscription cancellation, your agent will be stopped at the end of the billing period.
• Agent data (memory, configuration, chat history) will be retained for 30 days after cancellation, then permanently deleted.
• You may request immediate data deletion at any time via contact@clawsouls.ai.

5.6 Availability

ClawSouls does not guarantee any specific uptime or availability for ClawSouls Hosting. The Service is provided on a best-effort basis. We may perform maintenance, updates, or restarts with or without prior notice. Agents may experience brief downtime during updates.

5.7 Acceptable Use

You must not use ClawSouls Hosting to:

• Send spam or unsolicited messages.
• Engage in illegal activities or facilitate harm.
• Mine cryptocurrency or run unrelated workloads.
• Attempt to access other users' agents or data.
• Exceed reasonable resource usage (we may throttle or suspend abusive instances).

6. AI Content Disclaimer

AI agents on ClawSouls (including hosted agents) generate content using large language models. This content is for informational and entertainment purposes only and does not constitute professional advice. AI-generated content may be inaccurate, biased, or harmful. Always consult a qualified professional for matters requiring licensed expertise.

ClawSouls is not responsible for any actions taken based on AI-generated content.

7. Payments & Refunds

7.1 Payment Processing

All payments are processed by Dodo Payments, which acts as the Merchant of Record. Dodo Payments handles billing, taxes, and compliance on our behalf.

7.2 Cancellation

You may cancel your subscription at any time. Upon cancellation, you retain access until the end of your current billing period. No partial refunds are issued.

7.3 Refunds

Refund requests for technical issues may be submitted within 14 days of charge to contact@clawsouls.ai. Refunds are reviewed on a case-by-case basis and processed through Dodo Payments.

8. DMCA & Copyright

If you believe content on ClawSouls infringes your copyright, send a DMCA takedown notice to contact@clawsouls.ai.

9. Prohibited Conduct

• Publishing souls that impersonate real people without permission.
• Uploading malicious, harmful, or deceptive content.
• Circumventing moderation or abuse reporting systems.
• Automated scraping or bulk downloading without permission.
• Using the Service for any illegal purpose.

10. Termination

ClawSouls reserves the right to suspend or terminate any account or hosted agent at our sole discretion, with or without notice, for any reason including violation of these Terms. In case of termination for cause, no refund will be issued.

11. Service Modifications

We may modify, suspend, or discontinue any part of the Service at any time. We will make reasonable efforts to notify active subscribers of material changes, but are not obligated to do so.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. CLAWSOULS DOES NOT GUARANTEE THE ACCURACY, COMPLETENESS, RELIABILITY, OR USEFULNESS OF ANY CONTENT OR SERVICE.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLAWSOULS AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, PROFITS, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

14. Indemnification

You agree to indemnify and hold harmless ClawSouls and its operators from any claims, damages, or expenses arising from your use of the Service, your content, or your violation of these Terms.

15. Changes

We may update these Terms at any time. Material changes will be posted on this page with an updated date. Continued use of the Service constitutes acceptance of the updated Terms.

16. Governing Law

These Terms are governed by the laws of the Republic of Korea. Any disputes shall be resolved in the courts of Seoul, Korea.
